1. Introduction
Welcome to HostingFocus.com.au (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our services, including website hosting, domain registration, SSL certificates, and any related products (collectively, “Services”). By using our Services, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old and capable of entering legally binding agreements to use our Services. If acting on behalf of a business, you confirm that you have authority to bind the business entity.
3. Services
3.1 Website Hosting
We offer shared, VPS, and dedicated hosting services. While we aim for 99.9% uptime, we cannot guarantee uninterrupted service. Maintenance may occur with reasonable notice.
3.2 Domain Registration
We facilitate domain registration through accredited registrars (e.g., auDA for .com.au). Domain usage and ownership are subject to the respective registry rules.
3.3 SSL Certificates
SSL certificates are provided via third-party authorities. Their issuance and management follow the policies of the respective certificate authority.
4. Account Responsibilities
- Provide accurate and current account details.
- Keep login credentials confidential and secure.
- Notify us of any unauthorised access to your account.
5. Acceptable Use Policy (AUP)
You agree not to use our services to:
- Engage in illegal or fraudulent activity under Australian or international law.
- Send spam, malware, or perform phishing.
- Host infringing or offensive content.
- Bypass or tamper with server security.
Violations may result in suspension or termination of your services.
6. Payments & Renewals
- All fees are in AUD and include GST unless otherwise noted.
- Services are prepaid; automatic renewal applies unless cancelled beforehand.
- Non-payment may result in suspension or data loss.
7. Cancellations & Refunds
- Hosting services can be cancelled via the client area.
- Domains and SSL certificates are non-refundable once issued.
- Hosting may be refunded within 30 days of purchase (excluding domain or setup fees).
8. Data Backup & Security
We take reasonable security measures but do not guarantee data recovery. Clients are responsible for maintaining regular backups of their own data.
9. Limitation of Liability
To the extent permitted by law:
- We are not liable for indirect or consequential damages.
- Liability is limited to the fees paid for the affected service in the past 12 months.
10. Indemnification
You agree to indemnify and hold HostingFocus.com.au harmless from claims or damages arising from your use of our Services or breach of these Terms.
11. Intellectual Property
All site content, software, and branding remain our property. You may not copy or reuse materials without written permission.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Legal proceedings must be filed in the courts of NSW.
13. Amendments
We may revise these Terms periodically. Clients will be notified of significant changes. Continued use of Services implies acceptance.
